The Fourth Branch of Government
April 17, 2009 – 6:02 pmYou might have learned in Government or Civics class that our Federal Government is composed of three branches – the Executive, Legislative and Judicial. They forgot one – the administrative agencies who combine all three, becoming dictators-by-portfolio for their areas of specialization. Here’s an example: The EPA announced that they may declare carbon dioxide to be a a danger to public health, and to then regulate it under the Clean Air Act. In response, Sen. Boxer stated that the an nouncement was, “A wake-up call” to Congress to act. In other words, the EPA is telling Congress to do something about the problem, or they will.
Now, last time I checked, the Constitution was the Supreme Law of the Land, and the Constitution vests all legislative power in Congress. since when does the EPA order Congress around, and since when does an Executive Branch, sub-cabinet agency make de-facto laws? Since Congress created them, and since Congress decided to let the unelected officials at EPA implement their anti-capitalist agenda, shielded from responsibility to the public, since they don’t answer to us.
De Tocuqeville foresaw that America would not succoumb, if it did, to kings, but would see her democracy subverted by ‘guardians,’ who would rule us, for our own good. We’re there. The Constitution is DOA, and even if it wasn’t, this writer believes that Patrick Henry and the Anti-Federalists had a point, when they said, as Mr. Henry did, that the Constitution had an awful squinting, and it squinted towards tyranny, because the unelected judiciary answered to no one, and was checked by no one. The same applies to bureaucracies that exercise, among other things, judicial authority.
In closing, what do we do to get back our freedom?

The monster is out of the closet! I have worried for a long time about these agencies, and how they have the ability to put a stranglehold on us. Unfortunately, we have no tools to rid ourselves of these beasts other than complaining to our elected officials to disband them, and they have the full financial backing of the lobbyists.
